⭐This book is a must get if you are studying law. This book will keep you on top of your game understanding legal fictions.
⭐Lon Fuller taught me the elective course “Jurisprudence” 50+ years ago. I didn’t realize it until decades later but four or five deeply fundamental ideas he implanted in my head are useful to me constantly. This book (L. Fictions) is odd and interesting, in that much of it references _German_ law c. late 1920s. And Fuller was writing the essay(s) with those references without (apparently) having any glimmer [but who did?] of what lay just ahead. VERY RELEVANT TODAY IS: His discussion of the fiction of a CORPORATION as a PERSON(though my all-time favorite fiction continues to be “Equity regards that as done which ought to have been done” (which never worked for me when I tried it before a real (non-fictional) judge a couple of times. Of “anthropological” interest is his having found legal fictions as part of the system in what we might call primitive societies. He was a dear lovely man (which can’t be said of some of the other senior professors at HLS in my day.).
⭐A classic in legal writing. Too many are unaware of the essential role that fictions play, not just in law, but the proper use of them is critical, and only comes from deep understanding, such as we get from Sir Henry Maine (Ancient Law), and from Professor Fuller.
⭐Must read for every living human being.
